The following terms and conditions (collectively, these "Terms and Conditions") apply to your use of AnchorClub, including any content, functionality, and services offered on or via AnchorClub (the "Application").
IMPORTANT NOTICE: THESE TERMS CONTAIN SIGNIFICANT DISCLAIMERS REGARDING SAFETY AND LIMITATIONS OF LIABILITY. PLEASE READ SECTIONS 2, 3, AND 8 CAREFULLY.
By installing, accessing, or using the Application, you accept and agree to be bound and abide by these Terms and Conditions. If you do not agree to these Terms, you must not access or use the Application.
1. The Nature of the Application (Secondary Aid Only)
1.1 Not a Substitute for Seamanship: You acknowledge that AnchorClub is a supplementary aid to situational awareness only. It is not a replacement for:
• Official maritime charts or navigation equipment (ECDIS/Chartplotters).
• Radar, AIS, or depth sounders.
• A physical anchor watch.
• The prudent seamanship and watch-keeping duties required by international maritime law (COLREGs) and local regulations.
1.2 Skipper’s Responsibility: You agree that the Master/Skipper of the vessel remains solely responsible at all times for the safety of the vessel, the crew, and the decision of where and how to anchor. You agree never to rely solely on this Application to prevent grounding, collision, or dragging anchor.
2. Technology Limitations and Risks
2.1 GPS and Location Accuracy: The Application relies on the Global Positioning System (GPS) hardware of your mobile device. You acknowledge that GPS accuracy can be affected by satellite availability, atmospheric conditions, and hardware limitations. We do not guarantee the precision of the location data provided.
2.2 Device Dependability: You acknowledge that the Application may fail to alert you due to factors outside our control, including but not limited to:
• Device battery depletion.
• Operating system settings (e.g., "Do Not Disturb," "Sleep Mode," or battery optimization features that kill background processes).
• Device volume settings or hardware failure.
• Lack of internet or cellular connectivity (for remote monitoring features).
2.3 Push Notification and Third-Party Dependency
You acknowledge that the Anchor Alarm and other real-time alert functionalities within the Application are entirely dependent upon the availability, reliability, and delivery mechanisms of third-party services, including but not limited to the Apple Push Notification Service (APNS) and Google's Firebase Cloud Messaging (FCM).
We cannot guarantee the timely, secure, or successful delivery of any push notification alerts. You agree that AnchorClub, its developers, and affiliates shall not be held liable for any failure, delay, or non-delivery of alerts caused by a disruption, maintenance, failure, or limitation of any third-party push notification service, mobile network, or operating system, and this shall not constitute a breach of our duty of care under these Terms.
2.4 Third-Party Weather Data Disclaimer
The Application may display or utilize weather, tide, and hazard data provided by third-party services, including but not limited to Open Meteo or similar open data sources. You acknowledge that we obtain this data from external sources and cannot verify its accuracy, completeness, or timeliness.
We disclaim all warranties, express or implied, regarding the accuracy of all weather, tide, and environmental data displayed in the Application. You must not rely on the Application for critical weather or navigational decisions. You are solely responsible for obtaining and verifying official maritime forecasts and weather warnings from governmental or certified meteorological agencies before making any decisions related to vessel safety or operation. We shall not be liable for any loss, damage, or injury resulting from inaccurate or outdated third-party data displayed in the Application.
2.5 User Network, Connectivity, and Community Features
You acknowledge that the features of the Application related to viewing nearby users ('neighbours'), user-reported hazards, or shared community information rely entirely on two critical, external factors: (1) the active use of the Application by others, and (2) the uninterrupted internet connectivity (cellular, Wi-Fi, or satellite) of those other users' devices.
We make no representation or warranty that any other users will be present, active, or visible to you in any location, nor that user-reported data will be timely, accurate, or complete. You agree that AnchorClub is not responsible for any failure to transmit or receive data regarding other users, hazards, or community information due to a user's lack of internet connectivity, poor signal strength, or any network failure.
The absence of a visible 'neighbour' or a user's recent update must not be interpreted as confirmation that the anchorage or area is safe, empty, or hazard-free. You shall not be liable for any claims resulting from your reliance on user-generated content or community network availability
2.6 Pressure Sensor and External Device Data
You acknowledge that the Application may utilize data from internal device components (such as barometric pressure sensors) or external third-party hardware accessories (such as draft sensors, wind instruments, or depth sounders) connected via Bluetooth or other means.
We cannot warrant or guarantee the reliability, accuracy, or calibration of any such sensor data. Readings may be affected by device casing, temperature, moisture, physical damage to the sensor, or poor connectivity to external hardware.
You agree that AnchorClub is not responsible or liable for any decisions made based on inaccurate, delayed, or failed pressure or other external sensor readings, and such failures shall not constitute a breach of our duty of care under these Terms. You must verify all critical sensor data using calibrated, dedicated marine instrumentation.
3. User Conduct and Communications
Your use of the Application is subject to all applicable laws. You are solely responsible for the substance of your communications through the Application. You agree not to upload, share, or distribute content that:
• Is unlawful, threatening, abusive, harassing, defamatory, or fraudulent.
• Victimizes or degrades individuals on the basis of religion, gender, race, or disability.
• Constitutes unauthorized advertising ("spam") or contains software viruses.
• Impersonates any person or entity.
We have the right, but not the obligation, to monitor and remove any content that violates these rules at our sole discretion. We may terminate your account without notice for violating these provisions.
4. Intellectual Property
All content presented on this Application (excluding user-generated content) is the property of AnchorClub. You are granted a limited, non-exclusive, non-transferable license to use the Application for personal, non-commercial use. You may not copy, reproduce, or distribute any part of the Application without our prior written permission.
5. Third-Party Links
This Application may contain links to third-party websites or services. We do not control these parties and are not responsible for their content, accuracy, or privacy practices. Accessing third-party links is at your own risk.
6. Disclaimer of Warranties
The application is provided on an "As is" and "As available" basis.
To the fullest extent permitted by law, we disclaim all warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose (specifically for marine navigation safety), and non-infringement. We do not warrant that the application will be error-free, uninterrupted, or free of viruses.
7. Limitation of Liability
7.1 Nothing in these Terms shall exclude or limit our liability for:
• Death or personal injury caused by our negligence.
• Fraud or fraudulent misrepresentation.
• Any other liability that cannot be excluded or limited by the laws of the United Kingdom.
7.2 Subject to Section 7.1, AnchorClub and its developers, employees, and agents shall not be liable for:
• Any damage to vessels, equipment, or property (including grounding, collision, or dragging).
• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of data, profits, or revenue.
7.3 Subject to Section 7.1, our total cumulative liability to you for any claims arising out of or relating to these Terms or your use of the Application shall in no event exceed the amount you paid to us for the Application in the twelve (12) months preceding the claim.
8. Indemnification
You agree to defend, indemnify, and hold harmless AnchorClub from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
• Your violation of these Terms and Conditions.
• Your use or misuse of the Application, including any accident, collision, grounding, or property damage that occurs while the Application is in use.
• Your violation of any third-party rights.
9. Modifications and Termination
We reserve the right to modify these Terms at any time. Your continued use of the Application following any changes constitutes your acceptance of the new Terms. We may terminate or suspend your access to the Application immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
10. Governing Law and Jurisdiction
These Terms and Conditions and any dispute or claim arising out of or related to them shall be governed by and construed in accordance with the laws of the United Kingdom. Any legal suit, action, or proceeding arising out of, or related to, these Terms shall be instituted exclusively in the courts of the United Kingdom.
